Terms of Use

The Dr. Smily platform is operated by Smily Pruthi, a sole proprietor trading as Dr. Smily Pruthi ("Dr. Smily", "we", "us" or "our") from Ludhiana, Punjab, India. These Terms form the agreement between you and Smily Pruthi when you create an account, purchase a plan or use the platform.

Our Privacy Notice and Refund Policy form part of these Terms. The plan description and final price shown immediately before payment also form part of your purchase agreement.

The platform is intended only for adults aged 18 years or older. A person under 18 must not create an account, purchase a plan or use protected content. We may ask for reasonable information to verify eligibility where required.

You must provide accurate information, keep access to your registered email and device secure, and promptly report suspected account misuse. Your account is personal to you, and you are responsible for activity carried out through it except to the extent caused by our failure to use reasonable security.

Unless a plan expressly states otherwise, paid plans are offered for use by eligible learners in India. Do not purchase from another jurisdiction unless the checkout expressly supports your location.

Dr. Smily provides medical education through rapid-revision video lessons, linked study notes and related learning activities. The platform does not provide medical diagnosis, treatment, emergency guidance, patient-specific advice, an accredited qualification or official examination guidance.

Do not use platform content to make patient-care decisions. Always follow your institution, regulator, supervising clinician, and current authoritative clinical guidance.

Do not submit patient names, medical records, clinical images, hospital identifiers or other identifiable patient information through support, WhatsApp, uploads or any platform feature.

Subject to these Terms and any applicable subscription, we grant you a limited, revocable, non-exclusive, non-transferable licence to access the platform solely for your own education. Your account and licence may not be shared, assigned, sold, or used for commercial teaching.

• Do not share credentials, sell access, evade device or access controls, or impersonate another learner.
• Do not photograph, screenshot, screen-record, transcribe, copy, print, systematically download, scrape, extract, or build a substitute collection from protected content except where applicable law expressly permits it.
• Do not upload, forward, publish, redistribute, sell, teach from, create derivative question banks from, or otherwise provide protected content to another person, group, website, messaging channel, institute, product, dataset, or artificial-intelligence system.
• Do not interfere with security, playback, availability, progress records or another learner’s use of the platform.
• Do not introduce malware, probe the service without written authorization, automate access, or attempt to discover another user’s information.

The platform and its original teaching materials—including questions, answer choices, explanations, illustrations, notes, teaching sequences, memory methods, Dr. Smily Signature Formulas, branding, and software—are owned by Dr. Smily Pruthi or used under licence. They may be protected by copyright, trademark, database, confidentiality, contract, and other applicable laws. Third-party names and materials remain the property of their respective owners.

Payment or access does not transfer ownership or grant permission to reproduce, distribute, publicly display, commercialize, or create competing materials from the content. Permission for any use beyond personal study must be obtained in writing from Dr. Smily Pruthi or the relevant rights holder.

Nothing in these Terms limits a right that cannot legally be restricted, including legally protected fair dealing or fair use. If an accessibility need requires a different content format or interaction, contact support rather than bypassing platform protections.

Protected pages may display visible or forensic markers linked to your account. The platform may record relevant security events and access patterns—such as copy, print, context-menu, session, device, or abnormal-access events—to deter misuse, investigate suspected leakage, protect learners and rights holders, and preserve evidence. These safeguards do not guarantee that every misuse will be prevented or detected.

When we reasonably suspect unauthorized acquisition or distribution, we may review relevant account and technical records, revoke sessions, restrict or suspend access, preserve evidence, and contact the account holder. For a serious or repeated breach, we may terminate access and pursue remedies available under applicable law, including injunctive relief, monetary claims, or a lawful referral to advisers or authorities. Any action will be proportionate to the circumstances and subject to applicable consumer and legal rights.

The subjects, features, access period, total price, included taxes and any upgrade terms shown at checkout apply to that purchase. Current plans do not renew automatically. Access begins only after payment is verified and ends at the stated expiry unless it is lawfully suspended, refunded or extended.

Payments are processed by Razorpay. We do not receive or store your complete card number, UPI PIN or banking password. A payment-provider acknowledgement confirms the transaction; any tax document that is required by law is the responsibility of Smily Pruthi as the supplier.

Our Refund Policy explains duplicate payments, access failures, accidental-purchase review, provider processing and the effect of a refund on access. Nothing in these Terms or that policy limits a right that applicable consumer law does not permit us to exclude.

We may send messages necessary to operate your account, including sign-in codes, payment or access updates, security notices, support replies and material legal changes. Promotional offers and optional push notifications use separate preferences where available and can be disabled without losing in-app service messages.

Protected video, payments, email sign-in, Google sign-in, push delivery, hosting and optional WhatsApp conversations rely on third-party services. Their own terms and privacy practices may apply when you interact with them. Choosing WhatsApp opens a conversation outside the Dr. Smily platform; never send payment credentials or patient information there.

We work to keep educational material accurate and useful, but medicine, curricula, and examination patterns change. We do not guarantee that every item is error-free, complete, current, or predictive of examination performance.

We may correct or update content and reasonably change the technical presentation of a feature. We will not deliberately remove the core paid access promised at checkout without a lawful remedy. Planned maintenance, provider outages and events outside reasonable control may interrupt access temporarily.

We may restrict or terminate access when reasonably necessary to address fraud, credential sharing, payment failure, abuse, legal requirements, security risks, or a material breach of these Terms. Where appropriate, we may preserve evidence and provide a way to contact support.

To the extent permitted by law, we are responsible only for direct loss that was reasonably foreseeable from our breach. We are not responsible for examination outcomes, independent clinical decisions, unsupported devices, failures caused by your network or device, or third-party services outside our reasonable control.

Nothing in these Terms excludes liability for fraud, wilful misconduct, gross negligence, or any statutory consumer right or liability that cannot legally be excluded or limited.

If you have a complaint, contact [email protected] or use in-app Support so that we can investigate it. Payment and refund complaints should include the registered email and payment reference, but never a card number, UPI PIN, OTP or banking password.

These Terms are governed by the laws of India. Courts and consumer forums with lawful jurisdiction in India may hear disputes. This does not remove any mandatory consumer forum, regulator or remedy available to you under applicable law.

We may update these Terms when the service or law changes. If a change is material, we will present the updated version for acceptance before continued protected access.
